1 Purpose and Scope

The purpose of these general terms and conditions is to define the terms and conditions under which James Saintène, social worker and member of the OTSTCFQ, provides his professional services for psychosocial assessments, individual counseling, and guidance.

Any service request, appointment scheduling, or signing of a specific consent form implies full and unreserved acceptance of these conditions by the client or their legal representative.

2 Nature of Services

The services offered include, but are not limited to:

  • Psychosocial assessments within the framework of opening a tutorship or homologating a protection mandate, in collaboration with the Curateur public or a court.
  • Individual counseling and psychosocial support.
  • Consultations for advice and clinical guidance.

Each service is performed in compliance with the professional practice standards dictated by the Ordre des travailleurs sociaux et des thérapeutes conjugaux et familiaux du Québec (OTSTCFQ).

3 Appointments and Booking Procedures

Requests for services can be made through the following channels:

The service agreement is considered concluded upon verbal or written confirmation of the appointment by James Saintène and after obtaining the free and informed consent of the client or their representative.

4 Rates and Terms of Payment

Fees are disclosed to the client prior to the start of any service. An official receipt is issued after payment is received, which can be used for insurance or tax purposes.

Financial Details
Pricing Fees for assessments, consultations, and follow-ups are communicated to the client during the initial contact or upon sending the service proposal.
Related Costs Specific administrative fees (writing official reports, travel expenses if applicable) are included or specified separately in the initial agreement.
Payment Unless agreed otherwise, services are payable at the end of each session or according to established milestones. Accepted payment methods are specified when scheduling the appointment.
Official Receipt An official receipt for insurance or tax purposes is issued after payment clearance. All amounts are in Canadian Dollars (CAD), plus applicable taxes.
5 Cancellation and Rescheduling Policy

To ensure proper schedule management and out of respect for professional availability:

  • Any cancellation or request to reschedule must be reported at least 24 to 48 hours in advance by phone or email.
  • In the event of a late cancellation or unexcused absence, compensation fees up to the full cost of the scheduled session may be billed.

6 Obligation of Means and Client Collaboration

Professional Commitment

James Saintène commits to leveraging all his professional skills, clinical expertise, and necessary resources to perform the service diligently and ethically. This constitutes an obligation of means, not of result.

Active Client Collaboration

The success of the psychosocial process or the accuracy of an assessment relies on the transmission of accurate, complete, and truthful information by the client or their authorized relatives.

The quality and reliability of a psychosocial assessment directly depend on the collaboration and transparency of the client during professional meetings.

7 Professional Secrecy and Liability Limits

All services are protected by the strictest professional secrecy, in accordance with the Code of Ethics of the members of the OTSTCFQ.

Legal Limits of Professional Secrecy

  • Imminent risk of danger to the client or others.
  • Order of a court or the Curateur public du Québec.
  • Statutory disclosure obligations provided by law.

Limitation of Liability

James Saintène cannot be held responsible for decisions made by the Curateur public du Québec, the courts, or any other legal authority following the submission of an objective psychosocial assessment.

8 Termination of Services

By the Client

The client may terminate the counseling or service provision at any time by notifying James Saintène verbally or in writing, subject to paying the fees due for services already rendered.

By the Professional

James Saintène may terminate services for just and reasonable grounds, including:

  • Loss of mutual trust or a conflict of interest.
  • Failure to respect the agreed financial terms.
  • A situation that exceeds the limits of his scope of competence.

In all cases of professional termination, James Saintène ensures the client is directed toward other appropriate resources, in accordance with his ethical obligations to the OTSTCFQ.

9 Dispute Resolution

In the event of a disagreement or dispute regarding the interpretation or execution of services, the parties commit to attempting to find an amicable solution in the first instance.

  • Failing an amicable agreement, the courts of the Province of Quebec (judicial district of Laval or Montreal) shall have exclusive jurisdiction.
  • The client retains the right at all times to contact the Office of the Syndic of the OTSTCFQ in the event of an alleged ethical breach.
